Dog Walking - Terms of Service Agreement

By using any Creature Kind Service, you are agreeing to the terms listed below

 

1. Key Definitions

​

  1. Client/Pet Owner - Meaning a person registered or using any of the Creature Kind services and or responsible for the welfare of the animal.

  2. Pets - Meaning animals registered under the care of Creature Kind

  3. Third Party - Meaning pet owner/home owner.

  4. Creature Kind/We/Our – Meaning all persons working for or linked to the Creature Kind Brand.

2. Client Obligations​

  1. All items required for the dog’s needs should be provided by the pet owner and be ready for the service commitment.​

  2. The Client shall ensure that Creature Kind has access to the Client’s home or other specified locations on the days and times agreed between Creature Kind and the Client for every service commitment as invoiced.

  3. The Client confirms that all information provided to Creature Kind is correct as at the time it’s recorded and should any information change it is the client’s responsibility to update Creature Kind.​

  4. The Client confirms that all vaccinations & treatments which an animal is obliged to have by law have been completed and will be kept up to date, in accordance with veterinary advice.

  5. ​The Client will ensure that their dogs if walked with Creature Kind, adhere to the Control of Dogs Order 1992. The order states that any dog in a public space must have a collar with tag which includes the name and address of the keeper clearly marked upon it.​

  6. The Client will ensure that their dogs if walked by Creature Kind are microchipped in accordance with the Microchipping Law 6th April 2016.

  7. The Client will notify Creature Kind of any civil or criminal court order relating to the Pet. Any orders imposed but not limited to the Dangerous Dogs Act 1991 or the Dogs Act 1871 imposing conditions, requirements or restrictions on the Pet such as a requirement to wear a lead and/or a muzzle when in a public place.  If such an order exists, the Client will provide a written copy of the order to Creature Kind.​

  8. The Client must advise Creature Kind of anyone who will have access to their property during any service commitment collections and drop offs, including but not limited to cleaning services, maintenance personnel, friends, family and neighbors.

  9. The Client will inform Creature Kind of any parking facilities and restrictions. If there is no free parking in the immediate area and the client is unable to supply an appropriate parking permits, then parking charges will be passed on to the Client.​

  10. It is the Clients Responsibility to ensure the Creature Kind has access a working set of Keys at all time. (Key Safe or Holding)

​​3. Personal Information​    ​

  1. It​ is the pet owner’s responsibility to keep us up to date with any changes regarding your contact numbers, your pet’s care needs, your emergency contact details and other necessary information. Should you have any concerns regarding your pets or our services you will contact us directly.

  2. At Creature Kind we love to take photos & videos of your pets and share them with you on social media. Creature Kind reserves the rights to use any content (Photos/Videos) without prior approval from Clients. Furthermore all such content remains the property of Creature Kind.​

  3. All Client information will be held securely by Creature Kind

  4. The Client agrees to provide Creature Kind with the details of an emergency contact. This person would be contactable in the event of an emergency when the owner is un-reachable and must be able to make decisions about your animals and property in your absence.

4. â€‹Liability

  1. ​​It is the client’s responsibility to ensure that the property, its contents, and pets are adequately insured throughout the duration of our services.​

  2. Creature Kind are not liable for any damages or injuries cause by your pets or other home occupants during our period of service.​

  3. If during Collection or Drop Off any issues with the home are identified, Creature Kind will make reasonable effort to contact the Client or nominated contact to advise.​

  4. Creature Kind does not accept responsibility for security of your premises, or loss, during the term of any agreed service.​

  5. At Creature Kind we treat your pets like our own and ensure that they are well loved and looked after in your absences. With any dog walking there is always a risk of injury to a dog, especially when other dogs are present. In the event of illness, Injury, Incident or death Creature Kind will not be held Liable.​

  6. You understand that there is always an element of risk when dogs are left at home unattended. In the unlikely event of illness, Injury, Incident or death, Creature Kind will not be held liable during visits or in between visits.​

  7. The Clients accepts all responsibility for any damage, loss or injury that may arise as a result of walking dogs off lead, when the client gives permission.​

  8. The Client will provide all relevant information relating to any in home security systems.​

  9. Creature Kind is not liable for any issues resulting in the failure of a home security system.

  10. Creature Kind shall not be liable for cancellation or delay in preforming our contractual obligations due to circumstances beyond our control. These included but are not limited to acts of God, War, Flooding, Fires, Government restrictions, Adverse Weather or Power failure.​

  11. The Client is responsible for any expenses and damages cause by the pet to any third party whilst in the public domain.

​5. Miscellaneous

  1. ​Any delay/disruption in services resulting from the Client’s failure or delay in complying with any of the provisions in Sections 1 through 8 shall not be the responsibility or fault of Creature Kind.

  2. Creature Kind shall act in accordance with all reasonable instructions, as agreed by both Client and Creature Kind.

  3. After any dog walk Creature Kind will endeavour to clean and wipe down all dogs as much as possible, but cannot be responsible for mess caused by pets after drop off.

  4. The Client will make available all necessary cleaning materials, towels and a coat if preferred.​

  5. Creature Kind reserves the right to postpone or cancel any services as we see fit, without prior notice.​Creature Kind will endeavour to visit/collect your pets as close to the prearranged time slots as possible. We do however reserve the right to arrive outside of the allotted times in unforeseen circumstances.​

  6. Creature Kind reserves the right to walk dogs on the lead if we feel it necessary for your dog’s safety.​

  7. Should any pet become aggressive or dangerous, Creature Kind will take whatever action we deem necessary to ensure the continued safety of the animal, other animals or people who may be encountered.​

  8. In the event of extreme weather that may affect our ability to carry out our usual services, Creature Kind will make contact with the Client to advise an appropriate course of action.​

  9. Creature Kind reserves the right to review its pricing structure. Any price increases will be issued with 1 month’s full notice to the Client.

  10. In the event that a client wishes to cease walking with Creature Kind, the notice period is 14 full day’s notice. This must be sent directly to Creature Kind in writing.

6. Health & Wellbeing

  1. ​It is the Clients responsibility to ensure that their dogs have not eaten in the hour before pick-up. This is to allow sufficient time for any food to digest before exercise, play or travel.​

  2. The Client understands that with any dog walks especially during spring and summer months, there is always a risk of picking up ticks. Creature Kind would recommend that all owners regularly check over their animals. Noting that special attention should be given to warmer/concealed areas. If you identify any ticks, care should be taken when removing.​

  3. Creature Kind reserves the right not to provide its services to animals with any contagious illnesses or diseases.​

  4. In the event of a Pet having a contagious illness or disease, the Client will be liable for the costs of treatment given to other animals, which become infected as a result.​

  5. If during our period of service the pet in taken ill or becomes injured, Creature Kind will notify the Client at the earliest opportunity, to take instructions or guidance. In the event that the Client or second contact should not be available, the Client authorises Creature Kind to arrange for any veterinary care that may be required. Creature Kind will always operate within the best interest to the pet.

  6. Creature Kind will make every effort to use a Clients normal Veterinary Surgery. In the event that the Clients normal Veterinary Surgery should not be available, the Client Authorises Creature Kind to appoint an alternative.

  7. The Client agrees to indemnify/reimburse Creature Kind for any costs incurred during veterinary visits or necessary treatment received in the owners absents.

  8. In the event of any veterinary visits, the Client will compensate Creature Kind for time spent outside of the services agreement. This will be charged to compensate Creature Kind for loss of revenue and be determined on a case-by-case basis.

  9. The Client agrees to take any necessary measures or precautions to ensure that their animals are continuously free of but not limited to contagious, infectious, or otherwise communicable diseases. The Client further agrees to notify Creature Kind immediately of any infectious and/or contagious disease or conditions their dog has been exposed to or is affected by. Such diseases and conditions include, but are not limited to: Distemper, Hepatitis, Kennel Cough (Bordetella), Parvovirus, Corona virus, worms, Lyme disease, Fleas, Pregnancy, Infectious Skin Diseases and Intestinal Parasites. Creature Kind reserves the right to refuse admission until satisfied that the condition is resolved.

​7. Payments & Holiday​

  1. Invoicing is carried out on or around the 20th of the month, with a date for last payment listed at the foot of the invoice.

  2. If full payment is not received by the invoiced date and the client hasn’t previously advised of late payment, a late payment charge will be applied to the next month’s invoice. Late payments are charges at £5.00 per invoice.

  3. Creature Kind will aim to give a month notice for any intended holiday. However, where this isn’t possibly, we will contact you at the earliest opportunity. We ask for the same from all clients, however if invoicing as already concluded for the intended month of holiday, cancellation of pre-booked dates will fall under our existing cancellation policy.

  4. ​All expenses incurred during any service commitment, as detailed in sections 1-8, must be paid by the Client in full no later than 7 Days after Invoice issue date. Failure to comply with the terms listed above will result in a £2 daily charge until payment is received in full. Any deviation from the terms above musts be agreed directly with Creature Kind and will be notarized and signed.​

  5. Please note that Creature Kind do not issue refunds for any early termination part way through service, in line with the current cancellations policy

​8. Cancellations

  1. ​If a client wishes to cancel a service that has already been invoiced, a full refund will be issued if 14 full day’s notice is received before the service commencement date. Notice must be given in writing to Creature Kind directly.​

  2. Any Cancellation with fewer than 14 day’s notice up to 7 full days before service commences will be charged at 50% of the agreed rate. Notice must be given in writing to Creature Kind directly.​

  3. Any cancellation with fewer than 7 full day`s before the service commences will be charged at 100% of the agreed rate.

  4. Cancellations will be repaid as credit towards the next month’s bill, unless otherwise agreed by Creature Kind.

Pet Sitting/Home Care Packages

Key Definitions

  1. Client/Pet Owner - Meaning a person registered or using any of the Creature Kind services and or responsible for the welfare of the animal.

  2. Pets - Meaning animals registered under the care of Creature Kind as agreed at the pre-service appointment.

  3. Third Party - Meaning pet owner/home owner.

  4. Creature Kind/We/Our – Meaning all persons working for or linked to the Creature Kind Brand.

 

 Client Obligations

 

  1. All items required for your pets needs should be provided by the pet owner and be ready for the service commitment.

  2. In the event that additional items should need to be purchased in the pet owners absents, receipts will be retained and the pet owner is responsible for the reimbursement of all items plus mileage expense and time.

  3. The Client shall ensure that Creature Kind has access to the Client’s home or other specified locations on the days and times to be agreed between Creature Kind and the Client.

  4. The Client confirms that all information provided to Creature Kind is correct as at the time it’s recorded and should any information change it is the client’s responsibility to update Creature Kind.

  5. The Client confirms that all vaccinations & treatments which an animal is obliged to have by law have been completed and will be kept up to date.

  6. The Client must advise Creature Kind of anyone who will have access to their property during any periods of the Client’s absence, including but not limited to cleaning services, maintenance personnel, friends, family and neighbours.

  7. The Client will inform Creature Kind of any parking facilities and restrictions. If there is no suitable free parking at the time of service commitment in the immediate area and the client is unable to supply an appropriate parking permits, then parking charges plus travel time charges will be passed on to the Client.

  8. t is the Clients Responsibility to ensure the Creature Kind has access a working set of Keys at all time.(Key Safe or Holding)

 

 

Personal Information

 Liability

  2. Creature Kind are not liable for any damages or injury cause by your pets or other occupants during our period of service.

  3. Should any repairs be necessary to secure the Clients property or prevent further damage, for example but not limited to flooding or break ins. Creature Kind will make reasonable effort to contact the Client or nominated contact for guidance. Should this not be possible Creature Kind will aim to prevent further damage and secure the property by any means necessary. The Client will indemnify/ repay Creature Kind all cost incurred including repair, time and mileage expense.

  4. Creature Kind does not accept responsibility for security of your premises, or loss, during the term of any agreed service.

  5. At Creature Kind we treat your pets like our own and ensure that they are well loved and looked after in your absences. In the unlikely event of illness, Injury, Incident or death Creature Kind will not be held Liable.

  6. You understand that there is always a risks to a pet when left at home. In the unlikely event of illness, Injury, Incident or death, Creature Kind will not be held liable during visits or in between visits.

  7. At Creature Kind we recognise that most cats are independent and often come and go as they please. In circumstances where the client does not have means for the cat to return to the house independently, i.e. a cat flap, we would recommend that cats are kept indoors whilst in our care. We can then monitor their health, wellbeing and feeding habits to identify any problems should they arise. However, should you wish for your cat to have free access to the outdoors we cannot be held liable for any disappearance, injuries or death.

  8. The Client will provide all relevant information relating to any in home security systems, including but not limited to home alarms, external and internal CCTV (camera systems)

  9. Creature Kind is not liable for any issues resulting in the failure of a home security system.

  10. Creature Kind shall not be liable for cancellation or delay in preforming our contractual obligations due to circumstances beyond our control. These included but are not limited to acts of God, War, Flooding, Fires, Government restrictions, Adverse Weather or Power failure.

  11. The Client is responsible for any expenses and damages cause by the pet to any third party.

 

 Miscellaneous

 

  1. The Client authorises Creature Kind to carry out the services as agreed/recorded in our pre-service meeting.

  2. Any delay/disruption in services resulting from the Client’s failure or delay in complying with any of the provisions in Sections 1 through 7 shall not be the responsibility or fault of Creature Kind.

  3. Creature Kind shall act in accordance with all reasonable instructions, as agreed in the pre service appointment by both Client and Creature Kind.

  4. The Client will make available all necessary cleaning materials, in the event of any mess made by Pets within their property during Pet Sitting services.

  5. Creature Kind reserves the right to postpone or cancel any services as we see fit.

  6. Creature Kind will endeavour to visit/collect your pets as close to the prearranged time slots as possible. We do however reserve the right to arrive outside of the allotted times in unforeseen circumstances.

  7. Should any pet become aggressive or dangerous, Creature Kind will take whatever action we deem necessary to ensure the continued safety of the animal, other animals or people who may be encountered.

The Client further agrees to notify Creature Kind immediately of any infectious and/or contagious disease or conditions their pet may have been exposed to or is affected by. Creature Kind reserves the right to refuse admission until satisfied that the condition is resolved.

 

Payments

 

  1. A non-refundable 25% deposit is due from the Client at the time of booking. The deposit to be paid within 3 days of the invoice issue date. (This will be confirmed in red on the Clients invoice)

  2. The remaining 75% balance is then due 30 calendar days before the service commitment date.

  3. All expenses incurred during any service commitment, as detailed in sections 1-7, must be paid by the Client in full no later than 7 Days after Invoice issue date. Failure to comply with the terms listed above will result in a £2 daily charge until payment is received in full. Any deviation from the terms above musts be agreed directly with Creature Kind and will be notarized and signed.

  4. Please note that Creature Kind do not issue refunds for any early termination part way through service. For example, but not limited to returning home from holiday earlier than expected.

  5. Services booked with less than 30 days until service commitment, must be paid in full within 3 days of the issue of invoice.

 

 

Cancellations

 

  1. A refund excluding any deposit paid, will be issued if 30 days’ notice is received excluding the first day of service. Notice must be given to Creature Kind directly.

  2. Cancellations notified with fewer than 30 days’ notice but up to 14 days before service commences will be charged at 50% of the agreed rate excluding deposit. Notice must be given to Creature Kind directly. The notice period does not include the first day of service.

  3. Any cancellation with fewer than 14 days before service commences will be charged at 100% of the agreed rate. The notice period does not include the first day of service.

  4. Please note all deposits are none refundable.
